The debate continues on the issue of what is a pet's real value if the animal is harmed or killed through someone's negligence or intentional act. This is a well written article, by a vet, saying that even she is ambivalent about the true worth of a pet. On the one hand, she's a pet owner and would be devastated if she lost her own pet to someone's negligence. She says she wouldn't sue unless the act was extraordinarily egregious. I think she doesn't know the answer to that question until faced with the issue. On the other hand, she's a vet and benefits from the lower malpractice insurance rates. She actually pays less than $200 per year! (She says the doctors are probably gasping at that one - well so are the lawyers!) My firm's malpractice rates are substantially more than that!

There has been a long history of pets being valued as property. When a pet was lost through negligence or an intentional act of violence the owner could only recover the "market value" of the animal. The laws are finally evolving to acknowledge that pets hold an important place in our hearts and in our families. They cannot be held to the same standard as a chair or other type of personal property. I hope no one ever has to experience the anguish of a lost pet, but if they do, the law is now starting to provide better compensation for that loss.

REP. KRISEMAN: IT'S TIME TO IMPROVE OUR GUIDE DOG LAWS

TALLAHASSEE, Fla. – Bipartisan legislation has been filed to revise the law related to service animals, providing more rights to Floridians with disabilities and to individuals who train guide dogs.

State Rep. Rick Kriseman (D‐St. Petersburg) has filed House Bill 1077, which prohibits discrimination of guide dog owners as it relates to housing accommodations, allows for the use of guide dogs in public and private schools, and provides a punishment to those who knowingly and fraudulently represent themselves as the owner or trainer of a guide dog.

“Our current laws related to service animals and guide dogs are woefully inadequate and out of step with recently revised federal regulations. Passage of House Bill 1077 will give needed protections to our most vulnerable citizens and their beloved guide dogs," said Representative Kriseman, who is the Florida House Democratic Policy Chair.

"The more exposure to real‐world experiences the dogs get during their training, the better prepared they will be when given the responsibility of serving as someone’s eyes. By ensuring full access rights for the tireless trainers, these dogs will no doubt go on to become unflappable guides, leading their handlers to an independent life," said Titus Herman, the CEO of Southeastern Guide Dogs, whose mission is to create and nurture a partnership between a visually impaired individual and a guide dog, facilitating life's journey with mobility, independence and dignity.

The companion to HB 1077 will be filed by State Senator Mike Bennett (R‐Bradenton).

Bennett Files Animal Rescue Act to Save Lives, Taxpayer Dollars

TALLAHASSEE, Fla. – Combining compassion and business sense, Senator Mike Bennett, RBradenton,filed a bill today aimed at saving taxpayer dollars along with the lives of Florida’s fourlegged friends. Filing the Florida Animal Rescue Act, Senate Bill 818, Bennett explained that by sending animals to non-profit animal rescue organizations instead of killing them, costs are transferred from taxpayers to private organizations, and the burden on publicly funded shelters is reduced. Costs previously used for killing animals can then be focused on revenue-boosting adoptions.

“Florida has an opportunity to join other states setting a nationwide example by passing a bill that could

save thousands of animals and help direct dollars toward other important initiatives,” said Bennett.

“When we are not using dollars to care for, kill and dispose of animals, there is an immediate cost

savings to local governments.”

Calling it both a compassionate and smart decision, Bennett added that killing animals takes an

incredible toll on shelter staff members who often experience emotional trauma and exhaustion. This measure would spare them such a burden when animals have lifesaving options available.

The Florida Animal Rescue Act also offers protections for the safety of both the public and animals, excluding dangerous dogs, irremediably suffering animals, and it would also exclude organizations affiliated with a volunteer, staff member, director or officer convicted of animal neglect, cruelty or dog fighting, suspending the organization while charges are pending.

Central Florida had a festival weekend - one of the highlights was the Veg Fest. Veg Fest is a vegan festival featuring vegan food vendors, spiritual life styles, animal welfare - just to name a few. The Center for Animal Advocacy had the opportunity to meet lots of interesting people while spreading the word about the importance of protecting the legal rights of animals. Attorney Peggy Hoyt was a featured speaker and presented on the topics of Estate Planning for Pets, Avoiding Veterinary Malpractice and Pets and Domestic Violence.

Co-founders, Casey Taylor and Attorney Kim Radcliffe were front and center manning the booth and making new friends for the Center. Casey did double duty representing the Center for Great Apes as well.

Feral cats originate from lost or abandoned cats that are unsterilized and allowed to roam. They are not tame cats in the sense that they are easily integrated into a domestic household. Many organizations promote the idea of trap, neuter and release or TNR. It helps to stop further reproduction of cats within a colony.

It appears this legislation is designed to frustrate veterinarians and put more money in the pockets of pharmaceutical companies. However, it's not all bad. One point is that veterinarians will not be permitted to charge a fee to write a prescription just because you intend to have the prescription filled somewhere other than the vet's office.

The picture he paints and the one he suggest veterinarians should support is the pure property theory. It's an interesting take on the subject because most pet owners I know spend tons and tons of money at the vet because they do love their pets as family members. You can't have it both ways - pets as property for malpractice insurance purposes and pets as family for treatment purposes. We need to pick one and I think the family theory wins!

Dr. Khuly takes on a really tough subject in this article about do-it-yourself euthanasia of pets - particularly dogs and horses. Euthanasia is not a pretty subject regardless of how it's carried out. Losing a loved pet just isn't something we want to think about. I've had the unfortunate experience to lose a number of pets. They were all humanely euthanized under the supervision of my veterinarian. My heart was breaking and I was sobbing. I can't even begin to imagine anyone using a firearm to "put their pet to sleep."

As you know, I have horses. Fortunately I've never had to put a horse down or even watch the procedure for a friend's horse. I've read stories of people putting their horses down and cry the whole time. I dread the day when it's my turn. Again, it will only be accomplished under the supervision of my veterinarian. Certainly not at the hands of my husband or one of his friends with a gun.

Our pets give us unconditional love for their entire lives. The least we can do is offer them a peaceful alternative when their time comes. Thanks Dr. Khuly for bringing this information to light.

This is one of the best articles I've ever read on the growing problem of euthanasia in shelters. It is a must read, but be warned, if you are a true animal lover, it will break your heart. Pets are being given up for "adoption" at alarming rates. The shelters can't keep up. They don't have enough money, enough staff, enough space. They have lots of compassion but the real, cruel world says, "make room for more." Bringing a pet into your home has to be a very serious and permanent decision. Pets are not temporary beings that can simply be tossed aside when we no longer have the time, the interest, the money, whatever. The excuses people make for giving up their pets would simply drive me crazy. And, I can't even imagine the terror felt by a once loved pet, now in prison, surrounded by people and other pets that are unfamiliar to them. No wonder they don't "show well" in their pens.

It's not too early to start thinking about how to protect your pets on the Fourth of July. My Papillon, Leiden, shakes so hard and her heart beat so fast I think she's going to explode. Inevitably at least one or two of our neighborhood dogs run away. They hear the noise and just start running. They have no concern for their safety - they just want to get away from that terrifying noise Good time to make sure your dogs identification tags and microchip are up to date and registered with a "get me home" organization. I used to worry a lot about how my horses would deal with fireworks. Some of my neighbors have had horses that were terrified when the fireworks started. I even bought "puff balls" to put in their ears. Well they hated that idea and actually, seem to deal with the fireworks better than the dogs.

This weekend has been particularly hot in Central Florida. As a result, I wanted to post/repost some tips about hot weather and pets. NEVER leave your pet in a car without proper ventilation - they can die in less than 10 minutes. We've all heard horror stories of people leaving their children in car seats in locked cars, along with the tragic results. Same thing happens when you leave your pet in the car - they die! If you must leave your pet in the car, you absolutely have to leave the sun roof open - all the way and the windows down. Your dog has to be able to get fresh air. Don't believe me, sit in a closed car, see how long before you absolutely can't stand it.

This ASPCA article has lots of good hot weather tips, including tips regarding pets around pools. A friend just recently lost her older dog to a drowning accident. This dog was no stranger to water - had been in and around this pool its whole life. Dogs and cats need supervision around pools. One day I was on the pool deck with two of my dogs. They were chasing each other around the pool. In a split second, they both fell in. Funny, initially until I realized that unless you've taught your dog to swim and where the steps are, they may panic. Both my friend and I jumped in and retrieved the dogs. Another thing, Corgis don't swim well. Their legs are too short and their bodies too fat! If you have a pool, teach your dogs to swim and how to get out. There are even devices you can buy to assist your pet in the event of an accidental dip in the pool.

It's time for me to get moving in that direction. My small dogs get their teeth cleaned, at a minimum, annually. Bigger dogs on an as needed basis. Cats, as well. Another friend said her dog was acting weird lately - turns out she had an abscessed tooth. One of my dogs got a small stick wedged in the top of her mouth once and it ended up doing damage to her teeth.

Here's an example of unjustified cruelty for vanity. It just doesn't make sense that we would kill an animal for only its fin. Hunters like to justify killing by saying they eat the meat and use every part. That might be true - to some extent. I'm pretty sure only the Indians and Eskimos, who depended on wildlife for their survival used every part. They had to - they couldn't run down to Publix and buy whale blubber or buffalo. Here are some good tips for what to do if you find a lost pet. The same could apply if you've lost a pet and you are trying to find them. Since the author is located in Miami, you'll have to revise to meet Central Florida's needs such as placing an ad in the Orlando Sentinel and contacting the Orlando SPCA or local Animal Control Services. Unfortunately, the SPCA doesn't take strays, just surrenders - people who can no longer take care of their pets.

Microchipping your pet is one of the best defenses against getting a lost pet returned. It doesn't cost a lot and can ensure the safe return of your pet. Another good idea I learned from a local rescue, Buddies for Life, when I adopted my two puppies, is to get an engraved tag that says, "Reward" and your phone number. I thought that was brilliant. So in addition to a microchip, my dogs wear reward tags.

Proper supervision of your pet and proper confinement are also important. You should never let your pet run loose. If a pet is outside, it must be in an enclosed area or under the control of an "invisible fence" type product. I've used the invisible fence successfully for years and currently have four dogs that wouldn't dream of leaving my yard. They aren't perfect though because they don't keep other animals out. Stray dogs, wildlife, etc. can still be a threat to your pet and you should supervise accordingly. For example, I never leave my Papillon unsupervised for even a second!

This is an issue I struggle with personally. Do our pets really need so many vaccinations? I appreciate Dr. Khuly taking this one straight on. Protecting our pets should be our first priority. However, over vaccinating and over medicating should not be at the top of the list. One of my horses, Tahoe, has extreme reactions to vaccinations so I'm hesitant to vaccinate him at all. He gets only the bare minimum of vaccinations and then only one at a time. I recently stopped giving him his annual rabies vaccine, thinking the chances of him getting rabies is probably pretty low and it's one shot he really reacts to.

My veterinarian, however, had some really good advice that as a legal practitioner I think is well-reasoned. He suggested that if my horse ever bit anyone that not having proof of rabies vaccine may result in an extended quarantine. So you might say, "my horse isn't going to bite anyone" and hopefully that's true. However, horses do bite, especially when we are sharing them with inexperienced little people who want to give them a treat. In fact, after saying this myself, Tahoe did actually get my finger as opposed to his carrot the other day. It wasn't serious and of course, I didn't go to the doctor. But...if someone is bitten and they do go to the doctor, the doc is required to report the bite. That's when the trouble can start.

So, protect yourself, and protect your pets. If you aren't sure of your legal rights regarding animal law (or as some might call it, dog and cat law), we'd be happy to receive your questions. Love your pets!

Pets have long been like our children. Is it any wonder we would fight over who gets them in the event a relationship ends? Courts are ill-equipped to deal with pet custody issues as there just isn't much guidance in the law. There is no family law statute that discusses how the custody of pets should be determined. As a result, it is left up to the pet owners to work out an amicable agreement among themselves. If they can't reach a consensus or mediated agreement and find themselves in the court system, the results could be unpredictable and less than optimum for the pet. I know of one instance where a couple was sharing custody of a dog - meeting at the vet's office for the swap. Once day, the husband arrived and let the dog out of the trunk of the car! Dear Florida Grassroots Animal Advocates,

Thanks to all of you who called (and called again), emailed, and visited with your elected officials on behalf of animals this year. Your outreach made a tremendous difference in helping advance legislation to protect animals and defeat legislation that would be detrimental to animal welfare. Below is a final report on animal-related legislation during the 2011 Legislative Session, as well as links to how each member voted. Following up with your lawmakers on their vote is extremely helpful to animals-it lets your elected officials know that you are paying attention to how they represent you!

Legislative Session 2011: A Mixed Bag for Florida's Animals:

Bestiality Bill Finally Passes Legislature, Awaits Governor's Approval: A bill to prohibit bestiality in Florida SB 344 (Rich)/HB 125 (Kiar) unanimously passed both chambers and awaits the Governor's approval.

Florida's Greyhounds Lose: The bill to remove minimum live race requirements for dog tracks (HB 1145 Young/SB 1594 Sachs) known as the "greyhound racing decoupling" bill, died in the final hours of Legislative Session. After passing 6 committees and both Chambers, the House and Senate refused to concur on the slightly different versions of the bill, and the measure died. Racing greyhounds endure lives of confinement and suffer severe injuries. There are an estimated 8,000 racing greyhounds at any given time on Florida's tracks. Based on the industry average, these dogs will be replaced every 18 months with more dogs. Many are adopted, but some are not. We will continue fighting until we end greyhound racing in Florida, and we need your help. Please contact your state lawmakers and ask them to pass this bill next year.

"Ag-Gag" Factory Farm Cover-Up Bill Dies: SB 1246 (Norman, R-Tampa), which would make it a crime to take a picture or video on a farm without the owner's written consent, was withdrawn from its second and third committees before passing the Senate 25-10 (5 abstained). Even as amended, the bill would make criminals of anyone on a "farm" who takes a picture or produces a video of anything without the owner's written consent.

This bill would not only allow animal abuse to go unreported on factory farms and horse pastures, as well as other properties, but it would be detrimental to the environment as well as to public health and safety. (Note: Senators Garcia, Hays, Montford, and Siplin supported the bill in the Agriculture committee as well.) Florida should prevent animal cruelty-not prevent the public from learning about it.

Bill To Give Ex-Fighting Dogs a Fighting Chance Passes Legislature: A bill to remove the automatic dangerous dog designation for dogs removed from fighting operations unanimously passed the Senate, and passed the House 99-17. Animal Fighting Bill Dies, But Will Return Next Year: A bill to strengthen Florida's animal fighting law by clarifying the prohibition on animal fighting paraphernalia and protecting agencies from frivolous lawsuits by animal fighters passed the Senate Agriculture Committee unanimously. Unfortunately, the House Criminal Justice Subcommittee, the first committee of reference, didn't hear the bill before the committee stopped meeting. Sponsors have committed to support the bill again next year.

Spay/Neuter Bill Stuck in Committee: The spay/neuter funding bill (HB 359/SB 676) didn't receive a hearing in 2011. The current Legislative majority frowns upon bills that contain fees or generate revenue. These bills would raise funding for spay/neuter surgeries at the local level by adding a civil penalty onto citations written for violations of local animal control and cruelty ordinances. We are grateful to the sponsors, Senator Nan Rich, D-Weston, and Rep. Scott Randolph, D-Orlando, for filing these bills, and hope these bills will succeed next year.

Bill to Protect Pets from Domestic Violence Dies: A bill that would include pets in domestic violence protective orders (SB 206 Fasano) died without a House companion. The bill may be introduced next year.

Legislature Adopts Shelter Pet Resolution:

On April 6, the Florida Legislature adopted a resolution declaring April 2011 Adopt-a-Shelter-Pet Month. The resolution was sponsored by Senator Dennis Jones, R-Seminole, and Representative Mark Pafford, D-West Palm Beach.

Please contact your elected officials and let them know how you feel about their votes. It's important to thank them for voting to support animal welfare, and also to let them know you disagree with their votes on bills that would harm animals. Polite, respectful calls to lawmakers are the most effective way to communicate your views (second only to a face-to-face meeting).

Many of you may not know that your elected officials have offices in your home district. Please consider making an appointment over the summer or in the fall with your lawmakers to discuss these issues. Several of these bills will be back in January when the Legislature reconvenes, and if your lawmakers hear that you support or oppose the measures, it will make a difference. If you are interested in setting up a meeting and would like some assistance, please contact me. Pet custody cases are not as uncommon as you might think. Many couples--both married and unmarried--get pets together without any thought as to what will happen if their relationship doesn't survive. When I was divorced from my first husband, we had two cats, one dog. We had gotten the dog and one of the cats during our marriage. Fortunately, we were able to agree that I would take my original cat and the dog and he would keep our other cat. I can only imagine what would have ensued if we could not agree or if he had wanted to keep the dog. We were lucky.

Less fortunate couples have spent thousands of dollars fighting over the custody of their pets. One woman I met spent her entire retirement savings when she discovered her husband unloading their dog from the trunk of his car at the visitation drop off location (in this case the veterinarian's office and not McDonalds or Burger King as is common with visitation exchanges for children).

The law is not clear on pet custody issues and each case will be decided based on its own facts, circumstances and the whims of the court. Protect yourself and your pet with an agreement between you and your partner. The best time to do this is when the pet is acquired. These agreements should be in writing and reviewed by legal counsel. It is especially gratifying to send out a DawnWatch alert when I have superb coverage to report. Today I write about a series published in the McClatchy newspapers. McClatchy is the third largest newspaper company in the US, publishing approximately thirty daily newspapers with a total daily circulation of over two million. McClatchy-owned newspapers include The Miami Herald, The Sacramento Bee, the Fort Worth Star-Telegram, The Kansas City Star, The Charlotte Observer, and Raleigh's News & Observer. I will print the full list below so you can see if your local paper is among them.

McClatchy's investigative reporter, Chris Adams, has just released a three part series titled, "Chimps: Life in the Lab." It is a wonderfully detailed account of the lives of chimps in research, with arguments for but mostly against continuing to use them. The backdrop for the series is the current battle over the 180 chimps currently held at a federal primate facility in Alamogordo, New Mexico, who the National Institutes of Health is attempting to send back into research. Adams shares records from the lives of some of those chimpanzees, such as Lennie, who has undergone spinal taps and a bone marrow biopsy, and spent his life in various cages, sometimes in isolation.

Adams explains:

"In Defense of Animals, an advocacy group, obtained the records after a five-year legal fight with the NIH. The group shared them exclusively with McClatchy with no strings attached; McClatchy conducted its own review of the records, which provide the most detailed look ever into the day-to-day life of chimp experimentation."

The three stories that form the "Chimps: Life in the Lab" series are titled:

"As Science Turns From Chimp Research, US Wants to Restart,"
"Some chimps never recover from stresses of research"
and
"Some lab chimps left with poor health, shortened lives"

Both the Miami Herald and Kansas City Star are featuring the series today, Monday April 25, on their front pages, and many other papers are carrying the story.

I will paste a list of McClatchy Dailies below. If one of them is your local, please check your paper's site to see if they are carrying the chimp reports, and assuming so, please send an appreciative letter to the editor. We have an opportunity to keep this topic alive on the editorial pages, to let the media know that animal friendly coverage is appreciated and to let legislators (whose staff often keep an eye on letters pages as barometers of public opinion) know that Americans aren't proud to be the one country other than Gabon that still uses chimps in research. Our standout performance isn't limited to chimps: the European Union has banned testing on all animals for cosmetic purposes while in the United States that industry is alive and in fabulous shape. We have an opportunity, with our letters, to address all forms of animal testing, an industry which for too long has been blithely accepted by a trusting public.

If you have trouble locating the chimp stories in a search of your paper's website, or finding an address for a letter to the editor, don't hesitate to ask me for help. The site should have a tab on the front page (often at the very bottom) marked "contact us," which should lead you to a page that includes an email address or a link for letters to the editor.
